A written agreement must be fully executed and received by Ms. Jackie Ferrari, before an attorney-client relationship, or contractual relationship is established.

For this reason, it is recommend that You review these Terms of Service whenever You use this Site and/or the services of Jackie Ferrari.   Your use of the Site and/or Services following any such change constitutes Your agreement to follow and be bound by the modified terms and conditions of these Terms of Service.

If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be reformed only to the extent necessary to make it enforceable and the other terms of this agreement shall remain in full force and effect. You cannot transfer Your rights or obligations under this agreement to anyone without my written permission. Any failure to enforce any provision of this agreement does not waive my right to enforce the same provision in the future.

Additional TERMS OF SERVICE for Appearance Services.
Jackie Ferrari will not serve as Attorney of Record for any appearance.  In most all cases Ms. Ferrari will make the appearance, but in certain circumstances you agree that she may have an attorney colleague make the appearance.

Written Confirmation Required:  Every appearance request is subject to written confirmation by Jackie Ferrari.  You agree not to rely on coverage for requests where You have not received written confirmation and/or You have not supplied all necessary accurate information and documents. You agree that it is the responsibility of the Attorney of Record, Staff, Agent and/or Appearance Requester to confirm and verify the appearance is at my written confirmed time and place. My response in any way to Your inquiry of my availability and/or fee is Not written confirmation of an appearance. 

You agree that you have full and complete authority to request and pay the Appearance Service fee and any costs and expenses.

You agree that You have the responsibility to provide Ms. Ferrari with explicit, complete, clear and accurate information necessary to provide a professional appearance.  Information given by phone is not satisfactory and You agree that all information for the appearance must be submitted in writing and be complete at the time of the request.  Ms. Ferrari shall not have any obligation to contact the Attorney of Record, Staff, Agent or any Requester of an appearance for additional information.

You agree that Ms. Ferrari and/or attorney colleague will not be liable for any unfavorable results for any reason whether or not caused by the Attorney of Record, Staff, Agent and/or Appearance Requester negligence, misconduct and/or by the Attorney of Record, Staff, Agent or Appearance Requester failure to provide adequate information or instructions. If a court appearance is requested and you request and/or agree to using a telephonic court appearance "court call", you agree that Ms. Ferrari and/or attorney colleague will not be liable for any unfavorable appearance results due to any disconnection of phone lines, court errors, telephone call interruptions, providers of court call services, telephone company, equipment failures and/or communication failures with the court and/or employees of the court either before, during or after a court call is made and/or attempted.  

Attorney of Record, Staff, Agent and/or Appearance Requester will indemnify and hold Ms. Ferrari and/or attorney colleague harmless and defend us in any litigation arising from any unfavorable results for any reason whether or not caused or due to the Attorney of Record, Staff, Agent and/or Appearance Requester alleged misconduct and/or by interception of documents transmitted to or from Ms. Ferrari or any other reason.  This includes any malicious prosecution action arising from the matter.

Appearance and Cost Reimbursement:  You agree that Ms. Ferrari is will not be obligated to advance costs but shall be entitled to immediate reimbursement of all costs rendered with respect to a given appearance

Appearance Expenses:  No Charge for Parking Expense of $10 or less, although if the parking expense is greater than $10 then entire amount is due.  There is no charge for mileage of 10 miles or less.  Mileage exceeding 10 miles is charged at .55 per mile. Printing deemed necessary by Ms. Ferrari for the appearance of over 10 pages is due at .20 per page thereafter.

Additional Appearance Fees: You agree that a confirmed quoted flat fee appearance includes up to one hour of court time.  In addition to the appearance flat fee quoted there will be additional fees for time spent waiting, argument, delay, unanticipated circumstances, undisclosed information regarding the appearance or any other time requirement necessary for the appearance, whether known by you or not.  The additional time is calculated from the appearance time you requested until the end of the appearance. Any additional fees will be calculated at the rate of $25.00 for each additional 15 minutes or increment thereof.

Cancellation or Changes of an appearance: You agree that there is no charge for a confirmed appearance that is cancelled with at least 48 hours (2 business days) written notice before the scheduled service. There is a fifty percent cancellation fee for a confirmed appearance cancelled the business day before the scheduled appearance.  Appearances cancelled on the day of the appearance are charged the full fee.  If a matter has been removed from the calendar (off calendar) for any reason the full fee is due and payable since You agree that it is the responsibility of the Attorney of Record, Staff, Agent and/or Appearance Requester to confirm a matter is on calendar and/or at my written confirmed time and place of the appearance or court call appearance.

Legal Jurisdiction for appearance attorney fees, expenses, costs and collection for unpaid amounts:  You agree that any claim for unpaid fees, expenses and costs shall be venued exclusively in the West District, Santa Monica,  Los Angeles Superior Court  and that Ms. Ferrari will be entitled to recover all reasonable costs incurred, including without limitation all reasonable attorney’s fees and expenses.
