Legal Separation
If you have serious concerns if a divorce is right for you there may be  another option.  Legal Separation outlines and deals with the same issues such as dividing property, child custody and visitation and child and spousal support. This course of action allows couples to see how these issues will be separated and handled as if it was a divorce.  Although Legal Separation is a written agreement filed with the court it does not end the marital status and a couple continues to be husband and wife.  There are reasons for this, including religious or personal such as the decision to maintain medical insurance eligibility that would otherwise be terminated following dissolution of marriage.

If you are thinking about a divorce, but at the same time hoping to resolve your differences you may choose Legal Separation as an alternative, while keeping in mind that in most cases couples end up filing for a divorce.


Spousal Support
A party to a Divorce, Legal Separation or Annulment can ask a judge for Spousal Support to be paid while the case is going on. This would be a Temporary Spousal Support order. Permanent Support can also be ordered after a Divorce or Legal Separation becomes finalized.

Factors for Spousal Support are quite numerous and here are just some that are considered: The length of the marriage; needs of each person based on the standard of living they had during the marriage; the age and health of both people; debts and property; if a job would  make it too difficult to care for children.

When a judge makes a final Spousal Support order he will consider the factors in the California Family Code and this order will become part of your final Divorce or Legal Separation judgment.
